Partyzant\u00f3w 61a, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court in Bielsko-Bia\u0142a, 8th Commercial Division of the National Court Register, under KRS number 0000140697, Tax Identification Number (NIP) 9372176881, REGON 072161448, share capital 259,000.00 PLN, (hereinafter also referred to as the \u201eOwner,\u201d \u201eWebsite Operator,\u201d or \u201eSeller\u201d).<ul><li>A website located at <a href=\"https:\/\/zygzak-karting.pl\/en\/\">www.zygzak-karting.pl<\/a> This applies to the Zygzak-Karting go-kart track located at 26\u201328 Legion\u00f3w Street, 43-300 Bielsko-Bia\u0142a (hereinafter referred to as the \u201eTrack\u201d), which is owned by the entity operating the service (Apena Remont sp. z o.o.).<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>You can contact the website administrator using any of the following methods:<ul><li>at the phone number listed in the \"Contact\" tab;<\/li><\/ul><ul><li>by email using the following address: <a href=\"mailto:skleponline@zygzak-karting.pl\">skleponline@zygzak-karting.pl<\/a><\/li><\/ul><ul><li>through the contact form on the website;<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>For complaints, please use the following email address: <a href=\"mailto:reklamacje@zygzak-karting.pl\">reklamacje@zygzak-karting.pl<\/a> or by mail using the address of the registered office indicated above.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">2. GENERAL TERMS OF USE FOR THE ZYGZAK RACETRACK ONLINE SHOPPING PLATFORM<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>These Terms and Conditions set forth the rules for the provision of electronic services through the www.zygzak-karting.pl website, in particular for making reservations, entering into contracts for the provision of karting services, purchasing vouchers, Passes, and Tickets, as well as other products and services related to the operations of the Zygzak-Karting go-kart track. Use of the website is voluntary.<ul><li>A customer who is a consumer is a natural person who enters into a legal transaction with the Seller that is not directly related to their business or professional activity (\u201eConsumer\u201d). The provisions concerning the Consumer also apply to a natural person who enters into a contract directly related to their business activities, provided that the content of the contract indicates that it is not of a professional nature for that person, to the extent provided by law.<\/li><\/ul><ul><li>The purchase and reservation features may be used by an adult with full legal capacity, as well as by a person with limited legal capacity to the extent permitted by law or with the consent of a legal representative, hereinafter referred to as the \u201eCustomer\u201d;<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>The product may be purchased for a third party, including a minor, provided that the user meets the requirements specified in the track regulations and is under the required supervision or has the required consent.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Using the Purchasing Platform and the Reservation System does not require creating a permanent Account. To enter into a contract, you must provide the correct information necessary to process the Order, in particular a valid email address.<ul><li>Personal data is processed to the extent necessary to process the Order and fulfill the contract, in accordance with the terms set forth in the Privacy Policy.<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>The Terms and Conditions are made available free of charge prior to the conclusion of the contract in a manner that allows them to be obtained, viewed, and saved. Before placing an Order, the Customer is required to review the Terms and Conditions and, in the case of services provided at the Track, also the Track\u2019s rules and regulations.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">3. WEBSITE FUNCTIONALITY<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">On the zygzak-karting.pl website, customers can review the range of products and services offered and provided at the track, and, in particular, customers can learn about the types of go-kart rides available, the current price list, and all the rules and regulations that must be followed in order to be permitted to drive a go-kart on the track.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Customers may book rides in their chosen type of go-kart for a specific number of people on a strictly designated date by selecting from the available time slots in the ride booking system, which is part of the zygzak-karting.pl website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The zygzak-karting.pl shopping platform allows you to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>purchasing vouchers or passes for rides in a specific type of go-kart\u2014without specifying a particular date for use, but with an expiration date by which the voucher or pass must be used.<ul><li>purchasing tickets for a trip at a strictly specified time (date and time of travel) previously reserved by the customer in the zygzak-karting.pl booking system<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>registering for karting competitions or other announced forms of competition (reserving a spot in a specific event held at the Zygzak-Karting track on a specific date) and making payments for participation in the event<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The shopping platform allows users to pay online for purchased vouchers, passes, and tickets, and to pay for reservations made through the online platform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Detailed safety requirements, age, height, and health restrictions, as well as the rules for admission to the track, are set forth in separate track regulations, which are made available to the Customer prior to purchase. The provisions of the track regulations concerning the use of the service form part of the contract if they were made available prior to its conclusion.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. HOW TO SHOP ON THE ZYGZAK-KARTING SHOPPING PLATFORM<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">All <strong>products with a specific delivery date <\/strong>(the date and time the trip begins) are hereinafter referred to as \u201e <strong>Tickets<\/strong>\u201d.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Orders are accepted through the website www.zygzak-karting.pl\n<ul class=\"wp-block-list\">\n<li>Everyone <strong>TICKET <\/strong>Purchased through the zygzak-karting.pl platform, this ticket entitles the holder to participate in one or more go-kart rides of a specific type on a strictly specified date and time.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The TICKET is delivered to the customer in digital form and contains all the information necessary for its use, including, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a unique session code (or codes) required to complete a lap on the go-kart track<\/li>\n\n\n\n<li>the date, time, type of ride, and type of go-kart for which the ticket was purchased.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The TICKET is valid only for the reserved trip indicated on it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Ticket entitles the Customer to use the service only on the date specified therein. If the Customer fails to show up, despite the Seller\u2019s readiness to perform the service, the Ticket becomes invalid, unless the Seller agrees to reschedule the appointment. If the Customer arrives at the scheduled time, presents a valid redemption code, and meets the eligibility requirements for the service, but the service is not provided for reasons attributable to the Seller, the Customer may choose an appropriate alternative date or a refund.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A customer who expresses a desire to make a reservation before the expiration date of a Voucher or Pass retains the right to use the first available date, even if it falls after the expiration date.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All Products <strong>without a specific completion date<\/strong>, but with a specific expiration date (the latest date by which the product can be redeemed) are hereinafter referred to as \u201e<strong>\u201dvouchers\" <\/strong>or<strong> \u201epasses\u201d<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Everyone <strong>VOUCHER or PASS <\/strong>A purchase made through the zygzak-karting.pl platform entitles the holder to use a specific type of go-kart service during the validity period indicated in the offer and in the voucher or pass.<ul><li>The purchase of a voucher does not constitute a reservation for a specific date. The customer should make a reservation well in advance, subject to availability.  The reservation becomes binding upon confirmation in the reservation system.<\/li><\/ul><ul><li>The zygzak-karting go-kart track is not liable if no space is available on the track at the time selected by the customer without a prior reservation.<\/li><\/ul><ul><li>Once a voucher has been redeemed, it cannot be used again.<\/li><\/ul><ul><li>Once the expiration date has passed, the voucher cannot be redeemed, unless the Store Owner decides otherwise.<\/li><\/ul><ul><li>Possession of a voucher or making a reservation for a ride does not exempt the participant from the obligation to meet all the requirements specified in the Terms and Conditions, which are a prerequisite for being allowed to drive a given type of go-kart, and the service provider shall not be liable for the purchase of a voucher or the booking of a go-kart ride by or on behalf of a person who cannot be permitted to drive a go-kart due to the participant\u2019s failure to meet the requirements that were clearly and unambiguously made available to the Customer prior to the conclusion of the contract.<\/li><\/ul><ul><li>Payment processing is handled by Przelewy 24, which provides payment services in accordance with its terms and conditions and policies. The owner does not provide payment services nor is it a party to the payment services agreement.<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>The customer should verify that the email address is correct before placing an order.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">5. Buying Guide:<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Before making a purchase, the customer should review the price quote and the terms and conditions of the purchase; if the purchase involves a go-kart ride, the customer should also review the eligibility requirements for go-kart rides before making the purchase.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Before booking a go-kart ride or purchasing a go-kart ride voucher, the customer is required to ensure that they will be able to complete the purchased ride, taking into account, in particular, the regulatory requirements necessary for a person to be permitted to drive a go-kart, such as e.g., appropriate physical conditions (minimum height), the driver\u2019s age and health status, or possession of the relevant qualifications depending on the type of go-kart selected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Possession of a voucher, pass, or ticket DOES NOT EXEMPT the customer from the requirement to meet the rules and regulations for go-karting.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>After the customer selects a product in the desired quantity, click the \u201eBuy Online\u201d button. A message will appear informing the customer that the selected products have been added to the shopping cart.\n<ul class=\"wp-block-list\">\n<li>The customer can continue to add more items to the shopping cart, change the quantities, or remove items from the shopping cart until the order is finalized by the customer by<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Making a payment. The shopping cart always displays the current contents of the cart, including individual items and prices, as well as a summary of the total amount due for the order.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>After selecting the \u201eProceed to Payment\u201d option, a form will open where you must enter the customer\u2019s information required to complete the transaction and ship the order.\n<ul class=\"wp-block-list\">\n<li>The products available through the zygzak-karting.pl shopping platform are digital and are sent to the customer at the email address provided on the order form.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">All purchased vouchers, passes, and tickets have a unique redemption code that must be presented at the zygzak-karting go-kart track on the day of redemption.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The email will contain all the necessary information specifying the type of product purchased, the date of purchase, the expiration date, and any other relevant information to help you use the ordered products properly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The email will also include one or more attachments in the form of PDF files containing unique redemption codes for tickets, vouchers, and passes<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The customer confirms the order by clicking the \u201eProceed to Payment\u201d button\u201d<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The zygzak-karting platform accepts payments exclusively online through the Przelewy24 payment gateway.<ul><li>After selecting the \u201ePay via Przelewy24\" button, the customer will be redirected to the payment processing page.<\/li><\/ul><ul><li>The Customer places an Order by clicking a button that clearly indicates that the Order entails an obligation to pay, after reviewing its contents and accepting the Terms and Conditions.<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>The generation of unique voucher\/ticket\/pass codes and their delivery to the specified email address is performed automatically, immediately upon receipt of confirmation of payment.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">payment via the Przelewy24 online payment system.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The agreement is concluded upon sending the Customer an email confirming acceptance of the Order for processing. The confirmation is sent after Przelewy24 approves the payment. If the payment is not approved, the Order will not be accepted for processing.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; If the Customer\u2019s account has been charged and the Customer has not received confirmation of the Order or the purchased Ticket, Voucher, or Pass within 30 minutes, the Customer should contact the Seller. The Seller will verify the payment and then either fulfill the Order immediately or take the necessary steps to refund the amount charged.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You can cancel your order at any stage of the ordering process, up until payment is made<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">order, by stopping the process at any step and leaving the order placement page. An order for which the Customer does not complete the placement process is considered canceled, the contract is deemed not to have been concluded, and the order will not be fulfilled.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Immediately after placing an order, an email confirming the order will be sent to the Customer\u2019s email address provided during the purchase process. In this message, the Customer will receive a unique order number, which can be used, among other things, to check the order\u2019s status; subsequently, an electronic voucher will be sent to the Customer\u2019s email address.\n<ul class=\"wp-block-list\">\n<li>We reserve the right to contact the Customer at the email address provided by the Customer or by phone at the contact number provided by the Customer to clarify any questions, confirm the order, or address any other issues related to the order.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">6. PRICES<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Every product offered for sale on the zygzak-karting.pl online platform has a price listed in Polish zlotys. The prices listed on the website are gross prices and include VAT.<ul><li>The price listed on the website at the time the order is placed is the final price, binding on both the Customer and the operator of the shopping platform. Once an order is placed, the price of the ordered goods\/services will not change, regardless of any subsequent changes to price lists or the launch of promotional campaigns, sales, etc.<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>We reserve the right to change the prices of products in our online store, introduce new products and services for sale, conduct and cancel promotional campaigns on the store\u2019s website, or make changes to them.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These changes do not affect products purchased previously, including their prices.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>When announcing a price reduction, the Seller must also state the lowest price charged during the 30-day period prior to the reduction, and if the product has been on sale for less than 30 days\u2014the lowest price charged since the product was first offered, in accordance with applicable regulations.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">7. PRODUCT AVAILABILITY<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The ability to add a Voucher or Pass to the shopping cart indicates that it is available at the time the Order is placed, subject to payment confirmation and Order acceptance.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Products delivered electronically, including documents containing a unique order code, are sent at no additional charge to the email address provided by the Customer immediately after the contract is concluded.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A unique code is required to redeem the purchased service and must be presented during your visit to the Track.<ul><li>The code may be presented electronically\u2014specifically, on a phone screen\u2014or as a legible printout.<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>The code used to complete the service expires and cannot be reused.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The customer is required to protect the code from unauthorized access.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller shall not be liable for the use of the code by a third party who came into possession of it as a result of the Customer\u2019s actions or omissions, unless the Seller\u2019s liability arises from mandatory provisions of law.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Information regarding the validity period, go-kart type, ride duration, and additional requirements is provided in the product description before placing an order.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This information is also provided to the Customer in the contract confirmation or in the document authorizing the provision of the service.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The purchase of a voucher, pass, or ticket, or the reservation of a time slot, does not exempt the participant from the obligation to meet the requirements specified for the given type of go-kart.\n<ul class=\"wp-block-list\">\n<li>If, despite the availability indicated on the Website, it proves impossible to fulfill the Order\u2014in particular, due to the last available spot being reserved at the same time\u2014 the Seller will immediately notify the Customer and\u2014at the Seller\u2019s discretion\u2014offer an appropriate alternative date or refund the full amount received. The refund will be issued immediately, no later than within 14 days.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">8. TECHNICAL TERMS AND CONDITIONS FOR USING THE WEBSITE<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To use the Website properly, you must:<\/li>\n\n\n\n<li>having a device that allows access to the Internet,<\/li>\n\n\n\n<li>using the latest version of a web browser that supports the HTML5 standard,<\/li>\n\n\n\n<li>Enable cookies and JavaScript.\n<ul class=\"wp-block-list\">\n<li>The Owner\/Operator and the User are required to use the Website in a manner consistent with its intended purpose, applicable laws, and the provisions of this<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Terms and Conditions.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It is prohibited to take any actions that could disrupt the operation of the Website, in particular:<\/li>\n\n\n\n<li>interfering with the technical structure of the Website,<\/li>\n\n\n\n<li>attempting to gain unauthorized access to data or infrastructure,<\/li>\n\n\n\n<li>providing content, data, or code that could disrupt the system's operation,<\/li>\n\n\n\n<li>using the Website in a manner that violates the law or is contrary to public decency,<\/li>\n\n\n\n<li>attempting to misuse voucher\/ticket codes and other products belonging to other Service Recipients.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Seller may temporarily restrict or suspend access to all or part of the Website to the extent necessary to perform technical, maintenance, upgrades, development, or security-related activities, as well as in the event of a failure, force majeure, or other events beyond the Seller\u2019s reasonable control. To the extent possible, scheduled outages will be conducted in a manner that minimizes inconvenience to users, and the Seller will take reasonable steps to restore the Website\u2019s operation as quickly as possible.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The mere fact that the Website is temporarily unavailable does not constitute a failure to perform or improper performance of the contract if, taking into account the duration of the outage, the validity period of the Voucher or Ticket, and the actually available methods of redemption, the Customer still had a realistic opportunity to use the purchased service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller is not liable for the consequences of unavailability resulting from circumstances for which, under applicable law, the Seller is not liable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the unavailability of the Website\u2019s functionality necessary to book or redeem a Voucher or Ticket actually prevents the Customer from performing the required action before the expiration date, the Customer should report this to the Seller without undue delay, providing the Voucher or Ticket code and the approximate date and time of the unsuccessful attempt. In such a case, the Seller will extend the validity period of the Voucher or Ticket by a period sufficient to ensure that the Customer has a realistic opportunity to use it, which shall not be shorter than the period during which the Website was unavailable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If, despite the extension of the validity period, it remains impossible to perform the purchased service, or if the Seller informs the Customer that the service cannot be performed, the provisions of the Terms and Conditions regarding the inability to fulfill an Order shall apply. In particular, the parties may agree on an equivalent service or a new performance date; if no such solution is agreed upon, the Customer will receive a refund for the portion of the service that was not performed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">9. INABILITY TO FULFILL AN ORDER<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If performance of the contract proves impossible for reasons attributable to the Seller, the Seller shall immediately notify the Customer and, depending on the nature of the performance and the Customer\u2019s choice, shall offer equivalent performance or a new deadline, or shall refund the payment received.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller may refuse to enter into a contract prior to its conclusion only for valid reasons, in particular to protect its property, in the event of a violation of the law, these Terms and Conditions, the safety of the Platform, an attempt at fraud, or a threat to the property of the Seller or third parties. If payment has been collected, it shall be refunded immediately.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">10. DELIVERY METHOD AND ORDER FULFILLMENT TIME<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Deliveries of physical goods are made within Poland. International shipping is available. Shipping time and cost are determined based on the quantity of products ordered and the destination country.\n<ul class=\"wp-block-list\">\n<li>Deliveries of digital goods (in particular, vouchers or passes in the form of a PDF file containing a unique redemption code, and reservations for travel on a specific date)<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">(in the form of a PDF file containing a unique reservation code) are processed automatically by sending the file to the email address provided by the customer during the ordering process. To process this report, you will need to provide certain personal information so that we can verify the identity of the person reporting the issue.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">11. PAYMENT METHODS FOR ORDERS<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">All payments for orders placed on the zygzak-karting.pl platform are made online through the Przelewy24.pl payment service provider using the payment methods offered by Przelewy24.pl<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The payment transaction takes place between the customer and the selected payment provider.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>ATTENTION!<\/strong> The Online Store will never send a message to a Customer stating that the payment account has changed and requesting that the Customer make a traditional bank transfer or a payment in any form other than through przelewy24.pl.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a customer receives such an email, they should not make a payment or reply to it, and should forward the email as is to the address <a href=\"mailto:reklamacje@zygzak-karting.pl\">reklamacje@zygzak-karting.pl<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">12. SALES AGREEMENT<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The information provided on the Website constitutes an invitation to enter into a contract, not an offer as defined by the Civil Code. The procedure for placing an Order and entering into a contract is set forth in the section titled \u201eHow to Purchase on the Zygzak-Karting Purchasing Platform.\u201d.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller may refuse to accept an Order only for valid reasons specified in the Terms and Conditions, in particular to protect its property.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The agreement is executed in Polish.\n<ul class=\"wp-block-list\">\n<li>The parties will seek to resolve disputes arising from the agreement amicably.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In the absence of an amicable resolution, the dispute shall be settled by the court having jurisdiction in accordance with generally applicable laws. In agreements with Customers who are neither consumers nor entrepreneurs to whom consumer protection laws apply, the court with exclusive jurisdiction is the court having local jurisdiction over the registered office of the Website Operator.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">13. PERFORMANCE OF THE AGREEMENT \u2013 TERM<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Service Provider shall begin performing the contract after it has been concluded and payment has been confirmed, taking into account the type of service and the deadline specified in the Order.\n<ul class=\"wp-block-list\">\n<li>If it becomes impossible to provide the service within the specified time due to a breakdown, a safety hazard, a decision by the competent authorities, force majeure, or other circumstances that the Service Provider could not have foreseen or prevented, the Service Provider may cancel the trip or event. The customer will be offered an alternative date or, at their discretion, a refund for the unfulfilled service.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">14. TERMINATION OF THE AGREEMENT<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A consumer and a natural person entering into a contract directly related to their business activity, where the terms of the contract indicate that it is not of a professional nature for that person (\u201eEntrepreneur with consumer rights\u201d), may withdraw from a distance contract within 14 days without giving any reason, subject to the exceptions specified in the applicable laws and below.<ul><li>The right of withdrawal does not apply to contracts for the provision of services related to leisure or events if the contract specifies the date or period of service provision. This applies in particular to tickets for transportation, participation in competitions, and other events organized on a strictly specified date.<\/li><\/ul><ul><li>With respect to a Voucher or Pass without a specified redemption date, the right of withdrawal applies in accordance with general rules. If, at the express request of the beneficiary, the service begins before the expiration of the withdrawal period, the beneficiary shall bear the cost of the services provided up to the time of withdrawal, in proportion to the scope of the service performed. Once the service has been fully performed, the right of withdrawal expires if, prior to the commencement of the service, the beneficiary gave their express and prior consent, acknowledged the loss of the right of withdrawal, and received the required confirmation.<\/li><\/ul><ul><li>The period for withdrawing from a service contract begins on the date the contract is concluded, and in the case of a contract for the sale of goods\u2014as a general rule\u2014on the date the goods are taken into possession by the entitled party or a third party designated by that party, other than the carrier.<\/li><\/ul><ul><li>To exercise the right of withdrawal, you must submit an unambiguous statement to the Seller before the deadline expires, specifically:<\/li><\/ul><ul><li>using the form available on the Website, if provided;<\/li><\/ul><ul><li>by email to: reklamacje@zygzak-karting.pl; or<\/li><\/ul><ul><li>in writing to the Seller's registered office.<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>To meet the deadline, it is sufficient to send the statement before the deadline expires. The eligible party may use the sample form attached to the Regulations, but this is not mandatory.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the statement was submitted electronically through a feature of the Website, the Seller shall immediately confirm its receipt on a durable medium.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In the event of a valid cancellation, the Seller will invalidate any unused codes covered by the cancellation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The seller shall refund all payments received, including the cost of the least expensive standard shipping method offered on the Website, without delay, no later than 14 days from the date of receipt of the notice of withdrawal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of the sale of goods, the Seller may withhold the refund until the goods are returned or proof of their return is provided, whichever occurs first. COMPLAINTS<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The items for sale are vouchers and pass cards for go-karting at the zygzak-karting track, with a specified maximum validity period, as well as tickets for go-karting sessions on a predetermined date and time.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer should protect the order code from unauthorized access. The Seller is not liable for the use of the code by a third party if such use resulted from the Customer\u2019s disclosure of the code (in particular, due to the loss or dissemination of the order codes). This limitation does not apply to cases resulting from the Seller\u2019s actions or omissions.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A purchased Voucher, Pass, or Ticket may not be exchanged for another product, unless the Seller consents to such an exchange. A refund is available only in the cases provided for in the Terms and Conditions or applicable law.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A customer may file a complaint regarding a purchased product, service, or the fulfillment of an Order. The Seller is liable for the conformity of the service with the contract in accordance with applicable law, in particular the Consumer Rights Act and the Civil Code, depending on the type of contract entered into.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A customer may file a complaint in any form that allows the Website Operator to review its content, specifically by email to the address <a href=\"mailto:reklamacje@zygzak-karting.pl\">reklamacje@zygzak-karting.pl<\/a>, using the form available on the zygzak-karting.pl website or in writing to the Seller\u2019s registered office address. Use of the form is not mandatory.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If you file a complaint, please specify the reasons for the complaint and provide the information necessary to identify the order.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The website operator will review the complaint within 14 days and notify the customer of how it will be resolved via email.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">16. ISSUANCE of a sales document (receipt\/invoice)<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Purchases made through the zygzak-karting shopping platform are documented in accordance with applicable law (receipt\/invoice) and are delivered electronically to the email address provided by the customer during the purchase process.<ul><li>A customer making a purchase as a taxpayer who wishes to receive an invoice containing the purchaser\u2019s tax identification number (NIP) should request that an invoice be issued, provide the NIP, and supply the other information necessary to issue the invoice before making the payment and receiving a fiscal receipt. If the customer does not provide their tax identification number (NIP) before making the payment, and the sale is recorded on the cash register and confirmed by a fiscal receipt that does not include the NIP, the seller cannot subsequently issue an invoice for that sale containing the buyer\u2019s NIP.<\/li><\/ul><ul><li>A customer making a purchase as a consumer may request a personalized invoice that does not include a tax identification number (NIP) either when placing the Order or after it has been placed, within 3 months from the end of the month in which the service was performed, the goods were delivered, or full or partial payment was received, depending on the event documented by the invoice.<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>The Customer is required to provide accurate and complete information necessary for issuing an invoice. The Seller shall not be liable for errors in the invoice resulting from the Customer providing incorrect or incomplete information, subject to the Seller\u2019s obligations to correct the document as required by applicable law.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Processing of Personal Data<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In order to maintain the Customer\u2019s account, enter into and perform sales contracts, and fulfill the seller\u2019s obligations arising from the conclusion of distance sales contracts, the Owner processes the Customer\u2019s personal data, which the Customer provides voluntarily.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All information regarding the processing of personal data can be found under the tab <a href=\"https:\/\/walkazhalasem.pl\/polityka-prywatnosci\/\" target=\"_blank\" rel=\"noopener\">Politics<\/a> <a href=\"https:\/\/walkazhalasem.pl\/polityka-prywatnosci\/\" target=\"_blank\" rel=\"noopener\">privacy.<\/a><strong><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">18. AMENDMENTS TO THE RULES AND REGULATIONS<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller may amend these Terms and Conditions at any time, in particular in connection with a change in the profile, scope, model, or manner of conducting business; a change in the product or service offering or sales organization; the introduction, modification, or discontinuation of products or services; the development or modification of the Website; changes to available payment methods or order fulfillment, changes in legal regulations, the need to adapt operations to decisions, recommendations, or guidelines from competent authorities, as well as the need to ensure the security or proper functioning of the Website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Information regarding changes to the Terms of Service, the revised text, and the effective date of the changes will be published on the Website at least 7 days before they take effect. If an immediate or earlier implementation of an amendment is necessary due to applicable laws, a decision by a competent authority, the security of the Website, or the need to resolve a malfunction or threat, the amendment may take effect within a shorter period, as specified in the notice of the amendment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Amendments to the Terms and Conditions apply only to Orders placed on or after the date they take effect.
